Terms of Use

Effective October 20, 2026. These Terms are the end-user license agreement for the Crossing: Travel Phrasebook app.

In plain words

  • Crossing is for your personal use. Please don't copy the phrase catalog or misuse our servers.
  • Premium renews automatically through Apple or Google until you cancel in your store settings. They handle billing and refunds.
  • We work hard to get every phrase right, but language is messy. For medical, legal or emergency situations, get professional or local help too.
  • Crossing is provided as is, and our liability is limited as far as the law allows. Your rights as a consumer stay intact.
  • If you live in the United States, disputes go to individual arbitration unless you opt out within 30 days.

This summary helps you find your way. The full Terms below are what apply.

Please read section 19 carefully. If you live in the United States, it requires most disputes to be resolved by binding individual arbitration, and it waives class actions and jury trials. You can opt out within 30 days of first accepting these Terms.

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Inginity LLC ("we", "us"), 1021 Broad St #1017, Shrewsbury, NJ 07702, United States. They apply to the Crossing: Travel Phrasebook app, Crossing Premium, this website and our support (together, "Crossing"). By downloading, installing, accessing or using Crossing, or by buying Premium, you agree to these Terms. If you don't agree, please don't use Crossing.

Our Privacy Policy explains what information we handle and why.

2. Who can use Crossing

You must be at least 13 years old to use Crossing. If you're under the age of majority where you live, you may use Crossing only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf, and any purchase must be made or approved by them. In India, people under 18 may use Crossing's online features only with the verifiable consent of a parent or lawful guardian. You may not use Crossing where the law that applies to you prohibits it.

You don't need an account to use Crossing. If you create one, keep your sign-in details to yourself: you're responsible for what happens under your account. You can delete it in the app at any time.

3. Your license

As long as you follow these Terms, we give you a personal, limited, non-exclusive, non-transferable and revocable license to download and use Crossing on devices you own or control, for your own non-commercial purposes. If you got Crossing from Apple's App Store, section 17 also applies. We and our licensors keep all rights not expressly granted.

You're welcome to show phrases and cards on your screen to the people you're talking with, and to share individual phrases with friends and family for personal use.

4. Crossing Premium

4.1 What Premium is

Crossing is free to download and includes free features. Crossing Premium adds more, as described in the app when you subscribe. Premium is an auto-renewing subscription. The plans available to you, their prices in your local currency, and any free trial are shown in the app before you buy.

4.2 Billing

You buy Premium through the Apple App Store or Google Play, under their terms. Payment is charged to your Apple Account or Google account when you confirm the purchase or, if you start with a free trial, when the trial ends. We never receive your payment card or bank details.

4.3 Automatic renewal

Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the current period ends.

4.4 Free trials

The yearly plan may include a free trial of 7 days for eligible new subscribers. Unless you cancel at least 24 hours before the trial ends, your paid subscription starts and you're charged automatically. Apple and Google decide who is eligible, usually one trial per account. If you buy a subscription during a free trial, any unused part of the trial ends when the purchase takes effect.

4.5 Cancelling

You can cancel at any time in your store settings:

  • iPhone: open Settings, tap your name, then Subscriptions, then Crossing.
  • Android: open Google Play, tap your profile picture, then Payments & subscriptions, then Subscriptions, then Crossing.

Deleting the app doesn't cancel a subscription. After you cancel, Premium continues until the end of the period you've paid for and then doesn't renew.

4.6 Refunds

Apple and Google handle refunds for purchases made through their stores, under their refund policies and the law that applies to you. You can ask for one through Apple's Report a Problem page or Google Play's refund process. We can't issue refunds for App Store purchases ourselves. Except where the law or the store's policy says otherwise, payments aren't refundable and there are no refunds or credits for partly used periods.

4.7 Price changes

If your subscription's price changes, Apple or Google will tell you in advance and, where the law or their rules require, ask for your agreement before the new price applies. If you don't want to pay the new price, cancel before it takes effect.

4.8 Restoring Premium

Premium belongs to the store account you bought it with. On a new or reset phone signed in to that account, open Crossing's Premium screen and tap Restore purchases. A subscription bought on the App Store can't be moved to Google Play, or the other way around.

4.9 Changes to Premium

We keep improving Premium, so its features may change. We won't materially reduce what Premium includes during a period you've already paid for, unless we have to for legal, security or technical reasons outside our reasonable control, and in that case we'll tell you.

4.10 Right of withdrawal

If you're a consumer in the European Union, the European Economic Area or the United Kingdom, you may have a legal right to withdraw from a purchase within 14 days. Apple and Google administer that right for purchases made through their stores.

5. Phrases, translations and safety

5.1 A phrasebook, not an interpreter

Crossing's phrases, translations, pronunciation guides, romanizations and cultural notes are written and reviewed to be useful and accurate, but language varies by region, situation and person, and mistakes are possible. Pronunciation guides are approximations for English speakers. Audio comes from your device's text-to-speech voice, which we don't control and which may mispronounce words.

5.2 Their reply

Their reply uses machine translation on your device. Machine translation can be wrong, especially with typos, slang, names or unfinished sentences, so check anything important another way.

5.3 Health, safety and emergencies

Crossing is not a medical device and doesn't give medical, legal or safety advice. Phrases and cards about allergies, medical conditions, diet, emergencies or accessibility can help you communicate, but they can't guarantee that someone understands you or acts correctly. Don't rely on Crossing alone where a misunderstanding could cause harm: confirm directly with the people involved, carry the medication and documents your doctor recommends, and use a professional interpreter for medical or legal matters when you can. In an emergency, contact local emergency services first.

5.4 Local laws and customs

Cultural and etiquette notes are general guidance. You're responsible for following local laws and for how you use what Crossing shows.

6. Acceptable use

You agree not to do, or help anyone else do, any of the following:

  • copy, extract, scrape, sell, sublicense, publish or redistribute the phrase catalog or other content, in whole or in substantial part, or use it to build a competing product or to train a machine learning model;
  • reverse engineer, decompile or disassemble the app, except to the extent the law expressly allows despite this restriction;
  • bypass or interfere with purchase checks, App Check, security features or usage limits;
  • access our servers other than through the app, or send automated requests, excessive traffic or malicious code;
  • use Crossing to break the law, infringe anyone's rights, or harass, deceive or harm anyone;
  • remove or change proprietary notices, or present Crossing's content as an official or certified translation.

7. Our content and your feedback

Crossing, including its software, design, phrase catalog, translations, pronunciation guides, illustrations, and the Crossing name and logo, belongs to us or our licensors and is protected by intellectual property laws. These Terms don't give you any right to use our names, logos or trademarks. Open-source components in the app are licensed under their own licenses, which govern your use of those components.

If you send us ideas, suggestions or corrections, we may use them freely, without any obligation or payment to you.

8. Privacy

Our Privacy Policy explains what we collect, why, and the choices and rights you have. Saves about health, diet, emergencies and access needs, the cards you show, and anything typed into Their reply stay on your device.

9. Third-party services

Crossing works with services from other companies, including Apple, Google and RevenueCat, and uses your device's text-to-speech engine and Google's on-device translation models. Those services are governed by their own terms and privacy policies, and we aren't responsible for services we don't control. You must also follow any third-party terms that apply when you use Crossing, such as your mobile data plan, and your carrier's data charges may apply.

10. Changes and availability

We may update, change, suspend or discontinue any part of Crossing, including content and features. Some updates may be needed to keep using online features. Content already on your device keeps working offline, but we don't promise that Crossing will always be available, uninterrupted or free of errors. If we permanently discontinue Premium, we'll tell you in advance and stop future renewals, and you may be entitled to a refund under the store's policy or the law.

11. Changes to these Terms

We may change these Terms. When we do, we'll update the effective date. If a change is material, we'll give you reasonable notice in the app or on this website before it takes effect. Changes don't apply retroactively, and changes to section 19 don't apply to disputes that arose before we posted them. If you keep using Crossing after a change takes effect, you accept it. If you don't agree, stop using Crossing and cancel any subscription.

12. Ending these Terms

You can stop using Crossing at any time by deleting your account in the app if you created one, deleting the app, and cancelling any subscription. We may suspend or end your access to Crossing's online features if you seriously or repeatedly break these Terms, if the law requires it, or to protect Crossing, other people or us. Where it's reasonable, we'll tell you first. Sections 4.6, 7 and 13 to 22 continue to apply after these Terms end.

13. Disclaimers

To the fullest extent permitted by law, Crossing is provided "as is" and "as available". We and our licensors disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement. We don't warrant that Crossing's content is complete or free of errors, that the people you use it with will understand it, or that Crossing will be uninterrupted or secure.

14. Limitation of liability

To the fullest extent permitted by law, neither we nor our licensors will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or travel costs or arrangements, arising out of or relating to Crossing or these Terms, even if we were told they were possible. Our total liability for all claims relating to Crossing or these Terms is limited to the greater of the amount you paid for Premium in the 12 months before the event giving rise to the claim and US$50.

15. What these Terms don't limit

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence; liability for fraud, gross negligence or willful misconduct; your statutory rights as a consumer, such as the legal guarantee that digital content and services conform to the contract; or any other liability or right that can't be excluded or limited under the law that applies to you. Some places don't allow certain warranties to be excluded or certain damages to be limited, so parts of sections 13 and 14 may not apply to you.

If you're a consumer in the European Union or the United Kingdom, we're responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We aren't responsible for loss or damage that isn't foreseeable.

16. Responsibility for misuse

To the extent the law allows, if you use Crossing in breach of these Terms or the law, you'll compensate us for reasonable losses and costs, including reasonable legal fees, arising from third-party claims that result. This doesn't apply to consumers where the law doesn't allow it.

17. Apple App Store

If you got Crossing from Apple's App Store, you and we also agree to the following. If anything in this section conflicts with the rest of these Terms, this section applies to your use of the App Store version.

  1. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for Crossing and its content.
  2. Your license to use Crossing is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Crossing may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where Apple allows it.
  3. We are solely responsible for providing any maintenance and support for Crossing. Apple has no obligation to provide any maintenance or support services for it.
  4. We are solely responsible for any product warranties, whether express or implied by law, to the extent they aren't effectively disclaimed. If Crossing fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of Crossing to you. To the maximum extent permitted by law, Apple has no other warranty obligation for Crossing, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, subject to these Terms.
  5. We, not Apple, are responsible for addressing any claims by you or a third party relating to Crossing or your possession and use of it, including product liability claims, claims that Crossing fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.
  6. If a third party claims that Crossing or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  7. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Questions, complaints or claims about Crossing should be sent to us using the contact details in section 22.
  9. You must comply with applicable third-party terms of agreement when using Crossing, such as your wireless data service agreement.
  10. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

18. Google Play

If you got Crossing from Google Play, these Terms are between you and us, not Google, and Google isn't responsible for Crossing or these Terms. Your use of Google Play, and any purchase made through it, is also subject to the Google Play Terms of Service and Google's policies, and Google processes those payments and refunds.

19. Disputes and arbitration

19.1 Talk to us first

Most concerns can be sorted out quickly. Before starting any formal proceeding, you and we agree to try to resolve a dispute informally for at least 60 days after one side sends the other a written notice describing the dispute and the outcome requested. Send yours to info@inginity.studio with the subject "Dispute notice". Time limits for bringing a claim are paused during this period.

19.2 Binding individual arbitration in the United States

If you live in the United States, you and we agree that any dispute, claim or controversy arising out of or relating to Crossing or these Terms (a "Dispute") will be resolved by binding individual arbitration instead of in court, except as described in section 19.4. The Federal Arbitration Act governs this section 19.

The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules in effect when the arbitration begins, as modified by this section. The arbitrator decides all questions about the scope, interpretation and enforceability of this arbitration agreement, except that a court decides questions about sections 19.3 and 19.6 and whether a claim falls within section 19.4. Hearings take place by video conference or written submissions unless the arbitrator decides an in-person hearing is needed, in which case it will be held in the county where you live. Fees are governed by the AAA's rules. If you show that the costs of arbitration would be prohibitive compared with the costs of going to court, we'll pay as much of them as the arbitrator finds necessary to prevent that. The arbitrator may award the same individual relief a court could, and must follow these Terms and the law.

19.3 No class actions or jury trials

You and we may bring claims against each other only individually, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding, and may award relief only to the individual party seeking it, and only as needed for that party's individual claim. You and we both waive any right to a jury trial.

If a court decides that any part of this section 19.3 can't be enforced for a particular claim or form of relief, including a claim for public injunctive relief, that claim or relief, and only that, will be severed and decided by a court after the individual arbitration of all other claims is finished.

19.4 Exceptions

Either side may bring an individual claim in small claims court if it qualifies and stays there. Either side may also ask a court for an injunction to stop the infringement or misuse of intellectual property.

19.5 Opting out

You can opt out of this arbitration agreement by emailing info@inginity.studio within 30 days after you first accept these Terms, with the subject "Arbitration opt-out", your name, and a clear statement that you want to opt out. Opting out doesn't affect anything else in these Terms. If we change this section 19, you can reject the change the same way within 30 days after it's posted, and the version you last accepted will continue to apply.

19.6 Mass filings

If 25 or more similar demands for arbitration are filed against us, or by us, by the same or coordinated counsel or organizations, the AAA's Mass Arbitration Supplementary Rules apply, and you and we agree to cooperate in good faith so the demands can be administered in batches. Time limits for bringing claims are paused for demands waiting in a later batch.

19.7 Courts

If you don't live in the United States, if you opt out, or if a Dispute isn't subject to arbitration, the Dispute will be decided by the state and federal courts in New Castle County, Delaware, and you and we consent to their jurisdiction. If you're a consumer in the European Union, the United Kingdom, or another country whose law gives you this right, you may instead bring proceedings in the courts where you live.

20. Governing law

These Terms and any Dispute are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs section 19. The United Nations Convention on Contracts for the International Sale of Goods doesn't apply. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live.

California users: under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

21. General

These Terms, together with any terms shown to you when you buy Premium, are the entire agreement between you and us about Crossing and replace any earlier agreements about it. If any part of these Terms is found unenforceable, the rest stays in effect and that part will be enforced to the fullest extent permitted. If we don't enforce a provision, that isn't a waiver. You may not assign or transfer these Terms without our consent. We may assign them to an affiliate or as part of a merger, acquisition, reorganization or sale of assets, as long as your rights under them aren't reduced. We aren't responsible for delays or failures caused by events beyond our reasonable control. Apart from Apple as described in section 17, no one else has rights under these Terms. You must comply with the export control and sanctions laws that apply to your use of Crossing. If we translate these Terms, the English version controls to the extent the law allows.
